Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Ms. Trina Mitra, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.

As is reflected from the records of the case, the learned Special Court, NDPS Act, Nadia at Krishnagar is proceeding smoothly and expeditiously in respect of NDPS Case No. 28 of 2022 as already five witnesses out of seven witnesses so proposed have already been examined.

It has been informed that the next dates have been fixed on 26.07.2023 and 27.07.2023 for examination of the witnesses.

Learned trial court is directed to see that if the examination of the said witnesses is not completed on the fixed schedule, efforts be taken to complete the examination of such witnesses within a month thereafter. The learned court would thereafter take steps for examination of the accused under Section 313 of the Code of Criminal Procedure and after providing opportunity to the defence for

examination of its witnesses, fix dates for final argument and take all efforts so that the trial is concluded at the earliest. No unnecessary adjournment should be granted to either of the parties.

Learned public prosecutor conducting the case would make available the materials, exhibits and documents on the date fixed for examination of witnesses.

In case the police witnesses do not appear, the learned Special Court would immediately issue notice to the Superintendent of Police, Nadia for ensuring their appearance on the subsequent date so fixed.

With the aforesaid observations, the revisional application being CRR 2123 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
