Affidavit of service filed by the petitioner is taken on record.
The petitioner who is one of the members of Dhulauri Gram Panchayat submits that the Pradhan of the Panchayat was removed by a resolution taken in a meeting on 19th May, 2026 in terms of Section 12 of the West Bengal Panchayat Act, 1973.
By a notice issued on 25th May, 2026, the Prescribed Authority and Block Development Officer, Domkal Development Block, fixed a meeting for election of Pradhan on 3rd June, 2026. By a letter issued on 3rd June, 2026, the Prescribed Authority postponed the meeting due to non availability of police assistance. Further date of the meeting was fixed on 16th June, 2026
by a notice issued on 8th June, 2026. The said meeting was also postponed by a notice issued by the Prescribed Authority on 15th June, 2026 on the same ground. The petitioner seeks a direction upon the Prescribed Authority to convene the meeting at the earliest.
Learned counsels for the private respondents support the contention of the petitioner.
Learned counsel for the Union of India submits that the Union of India has no role to pay in respect to a meeting held for election of a Pradhan.
In view of the fact that the meeting called for election of the new Pradhan has been postponed on two occasions, the Prescribed Authority and Block Development Officer, Domkal Development Block, being the 7th respondent herein, is directed to convene the meeting within 10 days from the date of communication of this order upon service of notice to the parties concerned and take the proceeding to its logical conclusion at the earliest.
The Officer in Charge of Domkal Police Station, being the 6th respondent herein, is directed to render necessary police assistance to the 7th respondent so that the meeting is held peacefully and without any disturbance from any corner whatsoever.
The writ petition is accordingly disposed of. There shall, however, be no order as to costs.
Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. All parties shall act on a server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
