The petitioner through his learned advocate filed a representation before the Director of Public Instruction, West Bengal on 15th August, 2021 and alleges that the same has not been considered till date.

As it appears that the representation filed by the petitioner is pending consideration at the end of the Director of Public Instruction, no useful purpose will be served by keeping the writ petition pending.

The writ petition is accordingly disposed of by directing the respondent No. 2, the Director of Public Instruction to consider and dispose of the representation filed by the petitioner on 15th August, 2021, annexed at page 44 of the writ petition, in accordance with the relevant Rules/Guidelines at the earliest, but positively within a

period of eight weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

It is made clear that this Court has not entered into the merits of the claim of the petitioner and all points are left open to be decided by the said respondent at the time of consideration of the representation.

The petitioner is directed to forward a copy of the representation dated 15th August, 2021 along with the Rule/Circular which he relies upon at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
