Ruma Das Ms. Amrita Pandey Ms. Sneha Singh ...for the petitioner This application under Article of the Constitution of India is at the instance of the husband and is directed against a judgment and decree dated January 30, 2024 passed by the learned Additional District Judge, 2nd Court at Sealdah in Matrimonial Suit No.27 of 2020. Since the matrimonial suit has been dismissed by a judgment and decree dated January 30, 2024 an appeal lies therefrom.

Faced with such situation the learned advocate appearing for the petitioner prays for leave to withdraw this civil revision application with liberty to approach the appropriate forum in accordance with law.

In the light of the submissions made by the learned advocate for the petitioner, CO 1933 of 2024 stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law. The learned advocate on record shall be permitted to take back the certified copy of the judgment and decree by replacing the same with a photostat copy thereof.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
