The writ petitioner alleges that the private respondent, out of a personal grudge, has ensured that the petitioner is socially boycotted.

It is submitted that the petitioner is not being allowed to draw water from community sources and is not also being prevented from entering into the local market.

Counsel for the State, Mr. Banerjee, submits Inspector-in-charge, Harwood Point Coastal Police Station has conducted enquiries on the petitioner's allegations and found the same to be unsubstantiated. It is also submitted that the proceedings under Section 107 of the Code of Criminal Procedure have been drawn up by the said Police Station against the respondent no.9 on the complaint of the writ petitioner.

Having heard the learned counsel for the parties, this Court is of the view that the petitioner is entitled

to protection for atleast drawing water from the common source in the village.

The Officer-in-charge, Harwood Point Coastal Police Station is directed to ensure that the petitioner is given appropriate assistance of a Constable, in the event, any complaint is received of any obstruction in that regard.

The Officer-in-charge, Harwood Point Coastal Police Station shall also summon the respondent no.9 to the Police Station and a brief enquiry should be caused.

The said respondent no.9 must be appropriately warned.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
