For the Opposite Party no. 2 The petitioner who is the daughter-in-law of the private opposite party seeks quashing of proceeding being Complaint Case no. 99 of 2015 pending before the learned Judicial Magistrate, 5th Court, Sealdah. Learned counsel for the petitioner takes this Court to the order passed by the Hon'ble Division Bench of this Court on 19th May, 2022 in F.A.T. 183 of 2021 wherein the Hon'ble Division Bench has recorded that the petitioner and her husband agreed to settle their matrimonial dispute amicably as informed by the learned Mediator in a report submitted on 18th May, 2022.

One of the said terms of the said agreement was that the mother in law of the petitioner would withdraw the case filed against the petitioner and others. Learned counsel submits that despite such undertaking, the criminal case has not been withdrawn by the private opposite party till date. Learned counsel for the private opposite party submits that the private opposite party was not a party to the mediation and the order passed by the Hon'ble Division Bench of this Court was not communicated to her. The private opposite party undertakes to withdraw the complaint being no. 99 of 2015 pending before the learned Judicial Magistrate, 5th Court, Sealdah within three weeks from date.

Since nothing further remains to be adjudicated in the present application, the same is disposed of.
