Heard Learned Counsel for the parties.

It is fairly submitted at the Bar that though initially the case was initiated for the offences under Sections 304B/306/498A/34 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act, there is no allegation of any overt act on the part of the petitioner and others so far as the death of the deceased is concerned.

Regard being had to such facts and submissions and having considered that the petitioner is an old lady, it is directed that the petitioner shall appear before the learned Additional Chief Judicial Magistrate, Jangipur in the District of Murshidabad in Sagardighi Police Station Case No. 424 of 2022

dated 11.09.2022 within 15 days from today. On his appearance and application for bail she shall be released on bail on such terms and conditions as deemed just and proper in the facts and circumstances of the case.

Accordingly, the prayer for anticipatory bail is allowed.

The application being CRM (A) 2334 of 2023 is disposed of.
