Petitioner is aggrieved by the fact that inspite of the anticipatory bail of the respondents being rejected in connection with Thakurpukur police station case no. 242/2023 dated 01.09.2023, no steps were taken by the police authorities to trace out the respondents/accused persons and they are roaming freely and threatening the petitioner.

State has submitted a report. Report reflects that Title Suit no. 1920/2023 is pending, there were directions of restraining from alienating, encumbering or otherwise dealing with the property concerned but inspite of the same the private respondents are flouting the order. In view of the admitted position that the criminal case was registered on 01.09.2023 and more than one and half years have passed since then, I direct that in case the report under Section 173 of Code of Criminal

Procedure has not been filed till date, police authorities would put in efforts to file such report within a scheduled period of time preferably 60 days from date of this Order. Police authorities would also ensure that, if any charge-sheet is submitted then in that case the named accused persons who are to be tried are forced to appear before the Court of law.

With the aforesaid observations WPA 14794 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
