22.12 Ct. No. 29 akb C.R.R. 2662 of 2025 Santinath Nag Vs.

State of West Bengal Mr. Hare Krishna Halder Mr. Amitava Chowdhury ... For the Petitioner This is an application wherein the petitioner has prayed for a direction upon the Court below for expeditious disposal of the G.R. Case No. 513 of 2010 arising out of Sonamukhi P.S. Case No. 66 of 2010 dated 10.09.2010 under Section 466/420 of the Indian Penal Code presently pending before the learned Judicial Magistrate, 2nd Court, Bishnupur, Bankura.

It is submitted on behalf of the petitioner that the Inspector of Food Supply, Sonamukhi has lodged the FIR on 12th September 2010 and thereafter the charge was framed in the said G.R. Case No. 513 of 2010 on 15.11.2011 but since then the recording of evidence of prosecution witnesses is still going on. Considering the long pendency of the case the petitioner prays for a direction upon the Court below for expeditious disposal of the trial.

Having heard learned Counsel appearing on behalf of the petitioner and considering the fact that the prayer made on behalf of the petitioner is innocuous and if it is allowed in terms of the prayer made in the application the other party will have no cause to prejudice, service of copy of the application upon the opposite party is dispensed with. It appears that the case is pending for about 15 years after framing of charges. In such circumstances I find that the prayer made by the

petitioner herein is justified and required to be allowed for the ends of justice.

In such circumstances, the instant application, being C.R.R. 2662 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the case and if possible by making day to day trial without granting any unnecessary adjournment to either of the parties and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.

This order is passed invoking this Courts' jurisdiction under Section 529 of the BNSS.

Urgent Photostat certified copy of this order, if applied for, be given to the parties, on priority basis upon compliance of all necessary formalities.
