The writ petition is directed against an order dated DL-1 19.06.2023 Court No.5 (AD) February 28, 2023 by which, the claim for regularization of the writ petitioners was negated.

The writ petitioners were appointed on contractual basis in terms of a notice for walk-in selection of Senior Ayurvedic Medical Officer for engagement on contractual basis at the selected State Ayurvedic Dispensary at Bankura, Purulia and Paschim Medinipur Districts. Learned Advocate appearing for the writ petitioners submits that the writ petitioners worked meritoriously for a period in excess of ten years and are entitled to regularization.

It appears from the records that, the writ petitioners applied under the Right to Information Act and obtained information with regard to their appointments. It appears from the answers to the Right to Information Act queries that, the writ petitioners were appointed on contractual basis to sanctioned permanent vacant post.

It appears from the records made available to Court that, subsequent to the petitioners being appointed on contractual basis pursuant to the notice dated February 11, 2013, a drive for direct recruitment to the vacant posts was made by the authorities by a notice dated October 9, 2018. The writ petitioners participated therein and failed to qualify.

Writ petitioners were afforded a reasonable opportunity to be regularly appointed through a selection process of October 9, 2018. The writ petitioners as noted above participated therein and could not succeed. In such circumstances, we find no merit in the present writ petition.

WP.ST 93 of 2023 is dismissed without any order as to costs.
