Affidavit of service filed by the petitioner and report submitted by the State are taken on record.

The victim is not represented despite service. Heard learned counsels for the parties.

The petitioner was granted anticipatory bail by this Court on 11th January, 2017 following which he took regular bail before the learned trial Court.

The petitioner failed to appear before the Court on 19th December, 2019 for which warrant of arrest was issued against him. He surrendered before the learned trial Court on 1st February, 2020 and was granted bail. He again failed to appear before the learned Court on 30th August, 2022, for

which warrant of arrest was again issued against him. The warrant could not be executed for a considerable period of time till the petitioner chose to surrender before the learned trial Court on 22nd April, 2025. His bail prayer was turned down and he is in custody since then.

Learned counsel for the State opposes the prayer. Trial suffered due to abscondence of the petitioner for a long time. Considering the conduct of the petitioner, this Court is not inclined to release the petitioner on bail at this stage lest the petitioner again absconds, thereby causing delay in trial.

Accordingly, prayer for bail is rejected at this stage. The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties, in accordance with law.

The application for bail is thus disposed of. Case diary be returned.
