Pursuant to the order dated 13.07.2021, I/C, Dantan PS is present before this Court and files a report that due to inadvertence and mistake, service could not be effected upon the opposite parties. However, his office has put in effort subsequently and some of the parties were served according to the report so submitted. Let the report dated 15.07.2021 be kept with the record.
Personal appearance of the I/C, Dantan Police Station is dispensed with.
The present application has been preferred under Section 407 read with Section 482 of the Code of Criminal Procedure. Mr. Bhattacherjee, learned advocate appearing for the petitioner submits that because of threat perception, the present petitioner could not attend the court and depose before the court.
I have perused the charge-sheet and I find that all the witnesses are from the district of Paschim Medinipur. Having
regard to the inconvenience which may be caused to all the witnesses, I am of the opinion that this is not a fit case for transfer, as prayed for. However, the I/C, Dantan Police Station is directed to ensure proper security of the present petitioner.
The petitioner, after arriving at Dantan, will reach the Dantan Police Station wherefrom proper security arrangements would be made by the police authorities for attending the court.
The petitioner before entering the jurisdiction of Dantan Police Station would inform the I/C, Dantan Police Station through e-mail or by SMS regarding the purpose of visit.
Mr. Mukherjee, learned APP appearing for the State is directed to hand over mobile number of the I/C, Dantan Police Station to Mr. Bhattacherjee, learned advocate appearing for the petitioner.
In view of the aforesaid, no interference is called for in respect of the prayer/prayers advanced by the petitioner. CRR 2013 of 2018 is, thus, disposed of.
Interim order, if any, is hereby vacated.
All pending applications, if any, are consequently disposed of.
