05.07.2022 sdas rejected C.R.M.(DB) No. 2131 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kakdwip Police Station Case No. 395 dated 11.12.2021 under Sections 366/376 of the Indian Penal Code and Section 6 of the POCSO Act and Section 67B of the Information and Technology Act.

And In Re : Rajat Patra ..... petitioner Mr. Gouranga Kumar Das ... for the petitioner Mr. Ranabir Ray Chowdhury Mr. Sandip Chakraborty ... for the State Petitioner is in custody for 200 days. It is submitted that there was a love affair between the parties. Petitioner has been falsely implicated in the instant case.

Learned Counsel appearing for the State opposes prayer for bail.

We have considered the materials on record. Statement of the victim shows petitioner had cohabited with her and thereafter blackmailed her by threatening to upload objectionable pictures in social media.

In view of gravity of the offence and incriminating materials on record, we are not inclined to grant bail to the petitioner at this stage.
