Mr. Dyutiman Banerjee Mr. Vishal Mallick ....for the petitioners This is an application under Article 227 of the Constitution of India at the behest of the defendants seeking a direction upon the Trial Court to dispose of the application for temporary injunction as well as suit. The certified copy of the orders passed in the said suit would reveal that the application for temporary injunction was filed along with the presentation of the plaint yet it has not been disposed of.

We further find that other applications are also pending. The Counsel for the petitioner submits that there is no impediment in disposing of the pending applications as the parties have already exchanged the affidavits.

In view of the above, we request the Trial Court to dispose of the pending applications within one month from the date of reopening of the Court following the Puja vacation.

In order to adhere the time limit, it is open to the learned Judge in the Trial Court to prepone the dates if already fixed. The Trial Court shall also make endeavour to dispose of the suit, which is pending since last eight years, as expeditiously as possible. The Revisional application is, thus, disposed of.
