It has submitted by the learned counsel for the petitioner that the opposite party has expired. Considering all these facts and materials on record, the prayer of the appellant/petitioner is allowed. The criminal appeal against acquittal in a complaint case under Section 138 of the Negotiable Instruments Act stands disposed of for non-prosecution.
