1. In terms of previous order notice served upon the learned advocate for the State respondents is filed today and same is taken on record.

2. One supplementary affidavit is also filed on behalf of the petitioner and same is taken on record.

3. Petitioner is a retired Assistant Teacher, who superannuated on 28th February, 2017. Due to superannuation of the petitioner, 1st Pension Payment Order was issued on 02nd February, 2017 and as per the 1st Pension Payment Order disbursement of retiral dues was made in favour of the petitioner. Subsequently, due to revision of pay as per ROPA 2019 revised Pension Payment Order was issued on 8th March, 2022. Petitioner claims interest on revised gratuity as per revised Pension Payment Order due to delayed payment.

4. State respondents are represented by learned advocate.

5. Accordingly, the Director of Pension, Provident Fund and Group Insurance, West Bengal and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the petitioner on revised gratuity as per revised Pension Payment Order from 14th February, 2020 till the date of actual disbursement of the revised gratuity amount in favour of the petitioner, within a period of 8 (eight) weeks from the date of communication of this order.

6. Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

7. With the above observation, the writ petition stands disposed of.

8. There shall be no order as to costs.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
