The provisions of the Registration of Births and Deaths Act, 1969 have been placed.

This Court is of the view that the death of a person is ordinarily required to be registered at the place of last residence since, other legal consequences of death, normally follow thereat. This, however, does not mean that the place where the death actually occurred, cannot issue such certificate.

In those circumstances, this Court directs Naihati Municipality to be added as a party respondent to the instant writ petition.

Let appropriate death certificate be issued by the Naihati Municipality, endorsing and marking copy to the Halisahar Municipality. The Halisahar

Municipality shall make appropriate entries in their registry of deaths in respect of the deceased. The Naihati Municipality shall issue death certificate to the petitioner within a period of three weeks from the date of communication of this order. The writ petition being WPA 14369 of 2021 is, accordingly, disposed of.

Urgent photostat certified copy of this order, if applied for be given to the parties on priority basis upon completion of requisite formalities.
