Writ petitioner is an organising teacher of Bora Junior High School, DistrictPaschim Medinipur, who by instituting this writ petition, inter alia, has prayed for grant of approval of appointment as well as release of financial benefits. Mr. Ali, learned advocate, representing the petitioner has drawn attention of this Court to the order passed by this Court on 16th September, 2022 on another writ petition being WPA 2281 of 2019 (Sri Mangal Mandi & Ors. -vs- The State of West Bengal & Ors.) In WPA 2281 of 2019 petitioners claimed two reliefs, one is grant of approval of appointment in favour of the organising teaching and non-teaching staff and another is extending financial assistance in favour of the school. While deciding the issues this Court by passing order dated 16th September, 2022 refused to grant relief to the petitioners claiming approval of appointment as organising teaching and non-teaching staff. However, the issue relating to extending financial assistance to the school was decided to be considered on exchange of
affidavits by the parties. In view of the decision taken by this Court in WPA 2281 of 2019 no separate order need be passed on this writ petition since the petitioner being organising head teacher of the school has prayed for approval and release of monetary benefits. Such prayer of the petitioner is refused in view of the order dated 16th September, 2022 and accordingly the writ petition stands dismissed.
The copy of the order dated 16th September, 2022 passed in WPA 2281 of 2019 being countersigned by Assistant Registrar (Court) shall be retained with the record of this writ petition. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
