Report dated 30.06.2023 submitted by Mr. Imam, learned advocate appearing for the State be kept on record. Prima facie, it appears from the said report that the petitioner has roots in India. Consequently further detention of the petitioner in connection with Gaighata Police Station Case No. 160 of 2023 dated 20.02.2023 under Sections 14 of the Foreigners Act is unwarranted. As such, the prayer for bail of the petitioner is allowed.
Accordingly, the petitioner viz., Meraj Sk shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Bongaon.
If on bail, the petitioner shall meet the Inspector-inCharge/Officer-in-Charge, Gaighata Police Station or any police officer deputed by the said Inspector-inCharge/Officer-in-Charge once in a week till further orders of this Court.
The application for bail, being CRM (SB) 109 of 2023, is, thus, disposed of.
