Mr. Somnath Das ....for the petitioner Mr. Biswabrata Basu Mallick, Mr. Sanjib Das .......for the State The petitioner seeks higher scale of pay on account of having required post graduate degree in the year 2009. The petitioner was appointed as an Assistant Teacher by the School Service Commission on September 15, 2008. For the purpose of securing higher qualification or for seeking higher pay scale thereon, the prior permission of the D.I. of Schools, was not taken before the final examination towards undertaken. However, the approval of the concerned school since after coming into force of the Control and Expenditure Act, 2005, is absolutely no consequence. The prior permission of the D.I. of Schools, is required to ascertain as to whether the post graduate degree proposed to be obtained by the petitioner, would in any way benefit the State.
In that view of the matter, no relief can be granted to the petitioner.
With the aforesaid observations, the writ petition shall stand disposed of without any order. There shall be no order as to costs.
