Tarak Chandra Das @ Tarak Das v. State Of West Bengal And ORS.
D/L 203 11.07.2025 ct.no.35 Kausik W.P.A. 13471 of 2025 Tarak Chandra Das @ Tarak Das
Versus
State of West Bengal & Ors.
Mr. Sandip Kumar Mondal ...for the petitioner.
Mr. Tarak Karan ...for the State.
Petitioner complains of being assaulted at the behest of the private respondents. To that effect, information was furnished on or about 31.05.2025. However, the police authorities in spite of receipt of such information, according to the petitioner did not take any action.
Mr. Karan, learned advocate appearing for the State submits that proceedings have been drawn up under section 126/135(3) of the BNSS. In spite of the same, if the petitioner is of the opinion that cognizable offence has been made out, petitioner would approach the jurisdictional Magistrate.
Learned Magistrate would in such circumstances assess, ascertain and thereafter pass necessary directions as he deems fit and proper.
Police authorities would continue their surveillance and would ensure that no untoward
incident results because of the strained relationship existing between the petitioner and the private respondents.
With the aforesaid observations WPA 13471 of 2025 is disposed of.
Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
