Mr. Samrat Sen, learned Senior Advocate for the State has submitted that in respect of FIR No. 598 of 2021 dated August 1, 2021, Charge-sheet No. 770 of 2021 dated 27th October, 2021 under Sections 302/201/120B/34 of the Indian Penal Code read with Sections 25, 27 and 35 of the Arms Act has been filed. It is expected that the charge-sheet is put to committal and trial is commenced as expeditiously as possible.

It is submitted by Mr. Sen that two of the accused persons have been arrested and are in custody. It is further submitted that four other accused persons are absconding. It is also submitted that the learned Magistrate is seized of an application made by the police for proclamation.

The leaned Magistrate shall also consider, issuance of an order of attachment of property of the accused persons as may be identified by the police.

All steps must be taken by the police to enforce the attendance of the said accused in the trial. Counsel for the writ petitioner submits that his client continues to receive threats and has recorded complaints with the Inspector-in-charge, Nimta Police Station, inter alia, on 24th November, 2021 and 13th August, 2021.

The Inspector-in-charge, Nimta Police Station shall immediately look into the said complaint and take appropriate steps, inter alia, to ensure protection to the writ petitioner.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
