The revisional application under Article 227 of the Constitution of India at the instance of the defendant in a suit for eviction and is directed against order dated May 13, 2024 passed by the learned Additional Civil Judge (Junior Division) at Alipore in the said suit in Title Suit No. 824 of 2021.

The learned Trial Judge by the order impugned has been accepted the deficit court fees filed by the plaintiffs and has fixed June 03, 2024 for further evidence of P.W.1.

The defendant cannot be aggrieved by the order impugned.

C.O. 1944 of 2024 is, therefore, dismissed without any order as to costs.
