Affidavit-of-service filed in Court today be taken on record.

The petitioners are aggrieved that the private respondent is interfering with their rights of free ingress and egress on a pathway.

It is also submitted that the private respondent has demanded a sum of Rs.1,50,000/- for allowing them to use the said pathway.

The Inspector-in-charge, Domjur Police Station has filed a report dated 28th February, 2023. The same is taken on record.

It appears from the said report that Domjur Police Station have taken out proceedings under Sections 107 and 116(c) of the Code of Criminal Procedure in apprehending disturbance in the area. Domjur Police Station submits that there is no disturbance to the free ingress and egress on the pathway as on date. In the event of any future disturbance, the petitioners may take out appropriate proceedings before appropriate Civil Court.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
