The grievance of the petitioner is that the petitioner's shop room, situated at the ground floor of the relevant premises, despite having a trade licence, has not been given commercial electricity connection by the CESC Limited.

As per previous direction, a report is filed today on behalf of the CESC Limited which discloses, inter alia, that the other establishments in the premises apart from the applicant's portion, already have electricity connection.

However, the applicant's establishment was found to be under construction and admittedly is not getting any supply from any of the existing meter of the premises.

Fairly enough, the CESC Limited has stated in the report that upon completion of construction of the petitioner's commercial shop, the CESC Limited would proceed to offer a new separate supply at the existing meter board position of the premises upon verification of relevant ownership document, trade licence and compliance of other statutory formalities, in favour of the petitioner.

The report filed by the CESC Limited is kept on record.

However, learned counsel for the petitioner submits that the petitioner has already obtained trade licence for operating the shop from the said premises and requires electricity urgently.

Learned counsel for the CESC Limited, on instruction, submits that the CESC Limited has no objection in principle to give electricity supply to the petitioner's establishment from the existing meter board position, of course, subject to compliance of all formalities and productin of relevant documents by the petitioner.

In view of such fair stand having been taken by the CESC Limited, WPA No. 13622 of 2022 is disposed of by directing the CESC Limited to give a new metered electricity

connection to the petitioner at the existing meter board position of the premises-in-question, subject to compliance of all formalities and production of relevant documents by the petitioner, as expeditiously as possible, preferably within a week from compliance of all formalities by the petitioner.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
