The present writ petition has been preferred challenging an order dated 25th April, 2024, passed by the learned Tribunal in the original application (in short, OA), being OA 2098 of 2021 (LRTT). By the said order the OA was disposed of without entering into the merits of the case and granting liberty to the petitioner to take appropriate steps.

Mr. Samanta, learned advocate appearing for the petitioner submits that the petitioner did submit a proper representation to the respondent no.2 on 28th June, 2021 and the same was duly received but the concerned authority did not take any step.

Such contention has, however, been disputed by Mr. Dhar, learned advocate appearing for the State/respondents.

From the order impugned, it appears that there was a dispute as to whether the representation of the petitioner dated 28th June, 2021 was actually received

by the said respondent. In view of the liberty granted to the petitioner to take appropriate steps, we are of the opinion that no interference in called for in the present writ petition.

It is, however, made clear that in the event the petitioner submits any fresh representation to the said respondent no.2, the same shall be considered in accordance with law.

The writ petition, being WPLRT 79 of 2024, is, accordingly, disposed of.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
