Subal Chandra Dey Dhara v. State Of West Bengal And ORS.
April 24, 2023 AD - 40 Ct. 34 SG CRR 1818 of 2021 In Re. An application under Section 482 read with Section 483 of the Code of Criminal Procedure, 1973.
Subal Chandra Dey Dhara -versus- The State of West Bengal and others Mr. Imran Ali Ms. Debjani Sahu ... for the State.
The present revisional application was preferred for expeditious disposal of proceedings in connection with GR Case No.2179 of 2019 arising out of Beliaghata Police Station Case No.194 of 2019 dated 19.08.2019 under Section 420 of IPC.
None appears on behalf of the petitioner as well as the State.
Ms. Sahu, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. Her appearance may be regularised by the concerned authorities.
Record reflects that the stage at which the petitioner approached this Court, learned trial court was pleased to adjourn the proceedings because of pandemic.
Having regard to the reasons so assigned by learned magistrate, I am of the view that so far as the order is concerned, learned magistrate would take into account the grievance relating to the dissatisfaction expressed by the petitioner in the naraji petition provided the same has not been disposed of.
Charge-sheet has already been submitted, so pursuant to the naraji petition being decided, learned
magistrate would be at liberty to take steps for taking the main proceedings to its logical conclusion.
With the aforesaid observations, CRR 1818 of 2021 is disposed of.
Pending application, if any, is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J. )
