The petitioner has alleged that the respondent Nos.6 and 7 have made certain constructions on Holding No.833, Huchuk Para Lane, within Ward No.5, Purulia, without sanction from the authorities.

The respondent Nos.6 and 7 are represented by their learned Advocate who submits that the construction of a G+5 storeyed building was approved and sanctioned by the concerned municipality and the construction has been made on a land measuring about 11 cottahs.

Mr. Banerjee, learned Advocate appearing on behalf of the petitioner, submits that despite a query made under the

Right to Information Act, as to whether any sanction had been granted by the municipality or not, the municipality has not replied to such query.

Under such circumstances, this writ petition is disposed of with a direction upon the competent authority of the municipality to dispose of the query of the petitioner dated January 16, 2021, in accordance with law. Such disposal shall take place within a period of one month from the date of communication of this order.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
