Heard learned counsels for the parties.

The petitioner and the private respondent are holders of stage carriage permits. The petitioner contends that the timetable issued in favour of the private respondent clashes with the timetable issued in favour of the petitioner, for which the petitioner submitted an objection before the concerned authority on 22nd May, 2023, which is yet to be considered. The petitioner prays for a direction upon the authority to consider the objection and resolve the dispute with regard to the clash in the timetable of the petitioner and the private respondent.

It is submitted on behalf of the State respondents that the 3rd respondent be directed to consider the objection submitted by the petitioner, in accordance with law.

In view of the above, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the objection submitted by the petitioner dated 22nd May, 2023 within a period of one month from the date of communication of this order upon affording reasonable opportunity of hearing to the petitioner and the private respondent, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
