None appears either on behalf of the petitioners or the opposite parties today. It appears from record that on previous several occasions also, neither of the parties was present in Court.
Considering the above, record is taken up for delivering order.
In this case, the petitioners have prayed for quashing of the charge sheet in Kalyani P.S. Case No.182 of 2007 dated 21.8.2007 under Sections 406/420 of the Indian Penal Code in connection with GR Case No.626 of 2007 before the Court of ACJM, Kalyani, Nadia.
It is submitted that on the basis of the charge sheet as above, the Trial Court has proceeded to fix a date for consideration of charge. It is further submitted that the dispute between the parties was mainly civil in nature and attributes of the penal provisions of the law as mentioned above would not be
attracted to the same. Hence, the charge sheet filed was only perfunctory.
I have perused the material available on record. However, it is found that the grounds relied on by the petitioners could not be substantiated from the facts and circumstances and annexed documents in the case. Hence, I find that the Criminal Revision Case is not legible to be maintained. The same is, accordingly, dismissed.
Consequently, CRAN 2070 of 2013 is disposed of. Interim order, if any, stands vacated.
