Mr. Milan Mukherjee .... For the petitioner An order was passed by the learned Sessions Judge, Burdwan on 19th May, 2005 in Criminal Misc. Case No.2406 of 2004 under Section 408 of the Code of Criminal Procedure seeking transfer of Misc. Case No. 104 of 2003 registered under Section 125 Cr.P.C from the Court of learned S.D.J.M, Durgapur (as then was) to any other Court of co-ordinate jurisdiction at Asansol within the District of Burdwan.

Learned Sessions Judge having considered the merit of the application was pleased to reject the prayer. Challenging the said order of learned Sessions Judge, this application under Section 482 of the Cr.P.C was filed in the year 2005.

Mr. Milan Mukherjee, learned senior counsel representing the petitioner is quite justified in submitting that the matter has lost its relevance. Since the matter has become devoid of merit, I am inclined to dismiss it, however, without costs. Application, if any, and interim order, if any, stand vacated.
