Mr. Subrata Guha Biswas ... for the State in WPA 14504 of 2021 The above bunch of writ petitions has arisen out of similar issues with regard to the resolutions of the Regional Transport Authority with regard to permit of either auto-rickshaws or trekkers/magic vehicles.
Upon perusal of these writ petitions it appears that the resolution is not clear as to the requirement sought from the petitioners. For example, in one case permit has been asked to be surrendered wherein the petitioner never had a permit at all. It appears that a standard format of resolution has been applied in all cases without specifically going into each case properly. I have heard learned Counsel for the petitioners and for the State authorities.
Mr. Amal Kr. Sen, learned Additional Government Pleader appearing on behalf of the State has fairly submitted that the resolutions should have been better worded.
In light of the same, I direct the Regional Transport Authority to take up each of these matters specifically on the next Board meeting and pass specific directions for each of the writ petitioners.
With the above directions, these writ petitions are disposed of.
Since no affidavit-in-opposition is called for, allegations made in the writ petitions are deemed not to have been admitted.
