Mr. Barun Kumar Samanta ...for the Petitioner Mr. Mir Anuruzzaman ...for State of Orissa Mr. Srijan Nayak, Mrs. Rituparna Maitra ...for the State 18-09-2025 AKG Ct. 15 The petitioner submits that an inter-state stage carriage route permit was issued in his favour for the route from Duburi to Calcutta via Jamshola, Balasore J.K. Road. However, the petitioner was unable to operate his vehicle as the relevant permit was not countersigned by the State Transport Authority, Orissa.

Learned advocate appearing for the State Transport Authority, West Bengal, has produced a copy of a letter dated July 9, 2025. The relevant part of the said letter is quoted below:

"With reference to your letter as referred above, this it to state that in case of one inter-state stage carriage route namely Duburi to Kolkata via J.K.

Road, Balasore, Jamsola and back, one permit being no. WB2025-SC-0195A(I/S) was issued infavour of one Sima Maity.

But, later, it was found that the quota for permit in the said route is allotted only for Odisha. There is no such quota for West Bengal. One permit in the said route has been issued inadvertently to the above named incumbent i.e. Sima Maity."

It is an acknowledged position of the State Transport Authority, West Bengal, that the permit was issued in favour of the petitioner inadvertently. Therefore, there is no necessity to pass any order in this writ petition in favour of the petitioner.

The petitioner, however, submits that he has incurred considerable expenditure in acquiring the vehicle and has made an application before the State Transport Authority for the issuance of a permit for an alternative route. It is needless to mention that the authority shall consider the said application in accordance with law.

Accordingly, WPA 13677 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
