Learned advocate for the petitioners submits that the husband of the victim was granted statutory bail. He draws attention of this court to the averments made in paragraph 6 of the petition and submits that the petitioners were not residing with the victim or her husband at their matrimonial home. Learned advocate for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and considering the fact that husband of the victim was granted bail and that the petitioners were not residing with the victim and her husband at their matrimonial home, we are inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/-each with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the

petitioner no. 2 while on bail, shall meet the investigating officer once in a week until further orders. Petitioner no. 1 shall co-operate with investigation in accordance with law. Petitioners shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
