1. Heard the learned Counsel appearing for the parties.

2. The petitioner was in jail. He defaulted in appearance on the date fixed for charge. A petition by the defence Counsel had been filed before the learned court below on the ground mentioned therein. Such petition for adjournment was rejected and W/A was issued against the petitioner. The petitioner is stated to have surrendered before the court after coming to know about the issuance of the W/A on the next date fixed.

3. Regard being had to the facts and submissions of the case, it is directed that the petitioner shall be released on bail by the learned Additional Sessions Judge, 1st Court, Uluberia, Howrah in Special Case No.02 of 2018 on such terms and conditions as deemed just and proper in the

facts and circumstances of the present case and on the basis of previous bail bond, if the security has not yet been discharged.

4. Accordingly, the prayer for bail of the petitioner is allowed.

5. C.R.M.(DB) 2315 of 2023 is disposed of.
