1. Heard the learned Counsel appearing for the parties.

2. The case is based on circumstantial evidence and the circumstances suggest, prima facie, well designed murder of the wife.

3. Upon the consideration of the gravity of the evidence, we are not inclined to exercise the discretion in favour of the petitioner under Section 439 of the Cr.P.C. at this stage.

4. Accordingly, the prayer for bail of the petitioner is rejected.

5. C.R.M.(DB) 2316 of 2023 is disposed of.
