1. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years 11 months and till date, trial has not been concluded.
2. On the other hand, Mr. Mitra, learned advocate appearing for the NCB submits that 5575 bottles of Phensedyl were recovered in connection with the instant case and out of 7 (seven) witnesses proposed to be examined by the prosecution, 4 (four) witnesses have already been completed.
3. Having regard to the submission of the learned advocate appearing for the NCB, prima facie, it reflects that 3 (three) witnesses are left to be examined. Consequently, I direct the
learned 3rd Special Court (NDPS Act), Burdwan that in case the prosecution is unable to conclude the rest of the three witnesses by 28th February, 2026 and the petitioner applies for bail, the learned Special Court will leniently consider the prayer for bail of the petitioner.
4. The petitioner would cooperate with the learned Special Court in course of the trial and it is further directed that the trial of the case would continue in spite of resolution of the local Bar.
5. At this stage, CRM (NDPS) 751 of 2025 is dismissed.
6. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.
7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
