Affidavit of Service is taken on record. Despite service none appears on behalf of the respondent No. 6. The petitioners are the shop owners in Netaji Market, Benachity, Durgapur - 713213.

The petitioners allege that the respondent no.6 has been selling chicken from an adjacent shop without proper trade licence/permission from the Durgapur Municipal Corporation. A complaint has been lodged with the Commissioner of the Durgapur Municipal Corporation, which is Annexure-P4 to the writ petition.

The writ petition is disposed of with a direction upon the Commissioner, Durgapur Municipal Corporation to consider and dispose of the representation of the petitioners upon granting an opportunity of hearing to all concerned including the respondent No. 6. A reasoned order shall be passed and communicated to all the parties.

This Court has not gone into the merits of the claims and counter-claims of the parties.

The entire exercise shall be completed within a period of six weeks from date of communication of this order. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the learned advocate's communication.
