Learned counsel for the petitioners states that the petitioners have been falsely implicated. It has been stated that the only non-bailable offence alleged against the accused persons are 109 and 117(2) of BNS. Learned counsel submits that even as per FIR there was no weapon of offence. Learned counsel submits that the petitioners are ready to join the investigation. 2.

Learned counsel for the State submits that as per injury report, the injured had suffered injury having been assaulted with fist and blow. Learned counsel fairly stated that there are no criminal antecedents of the petitioners.

Perusal of the record indicates that the de facto complainant/injured was joined a witness in land inquiry case by the Block Land and Revenue Officer and during that injured was assaulted by the petitioners. As per injury report there was no

external injury and there was blunt trauma over right side of the chest. The injured was discharged on the same day after medical examination. There are no criminal antecedents. 4.

In the facts and circumstances, the petitioners are directed to join the investigation in the of IO feeling necessity of effecting the accused persons they may be admitted to anticipatory bail on furnishing a personal bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, subject to the condition that they shall not threaten intimidate or tamper with the prosecution witnesses and shall not enter the jurisdiction of Islampur P.S. till the investigation is concluded and charge-sheet is filed.

The application for anticipatory bail is, thus, disposed of. 6.

All parties shall act on the basis of the server copy of this order.
