The petitioner says that he is in custody for about two months and twenty four days. There was no recovery of contraband items from him. He has been implicated on the basis of statement made by a co-accused. He should be enlarged on bail.

Learned Advocate for the State produces the case diary for our perusal. We have read the statements of witnesses recorded under Section 161 of the Code of Criminal Procedure, 1973. The statements clearly implicate the petitioner. Further, we are told that the petitioner was absconding for about two years. In March this year, he applied for anticipatory bail. That application was dismissed by a co-ordinate Bench. Only thereafter, the petitioner surrendered.

In view of the aforesaid conduct of the petitioner, we are not inclined to allow the petitioner's prayer for bail, at this stage. Signed By :
