The petitioner prays for notional benefit in line with the order passed by the Court on June 29, 2022 in WPA No.11532 of 2013 (Anamika Mondal & Ors. -vs- The State of West Bengal & Ors.). The petitioner claims that she lies in the same footing as that of Anamika Mondal (supra).

It appears that the petitioner has filed a representation before the respondents in the year 2024, but the same is pending consideration till date.

As it appears that the representation of the petitioner is pending consideration before the authority, accordingly, without going into the merits of the same, the instant writ petition stands disposed of by directing the Principal Secretary, School Education Department or any of his authorized representative to consider the prayer made by the petitioner strictly in

accordance with law and in line with the order passed by the Court in the matter of Anamika Mondal (supra) at the earliest but positively within a period of eight weeks from the date of communication of this order.

If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken. A reasoned order shall be passed and communicated to the petitioner.

Learned counsel for the petitioner shall forward a copy of the representation along with all other supporting documents to the aforesaid respondent at the time of communicating this order.

It is made clear that the Court has not entered into the merits of the claim of the petitioner and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

8.

Certified copy of this order, if applied for, shall be made available to the parties.
