1. Learned Counsel for the State has filed the detailed report of S.I. of Police Paritosh Haldar. In the report, inter alia, it has been stated by the S.I. that the nexus between the car owner i.e., the petitioner and the driver, viz. Jakir Hossain Molla has to be investigated.
2. It has further been stated that as per the inquiry Mahadeb Das Mondal, who had executed the authorization letter dated 8th December, 2023, had already expired.
3. During the course of submission it has been submitted that the Charge Sheet has already been filed. Since the Charge Sheet has been filed, let the petitioner surrender before the learned trial Court.
4. The petitioner is granted liberty to move an appropriate application for Bail.
5. Learned trial Court shall consider the same in accordance with law without being influenced by the observation made in the present petition.
6. The petition is thus disposed of.
7. The Authorisation Letter annexed with the report filed by the State be kept on record.
