Tarun Kumar Patra v. State Of West Bengal

14.12.2021 sdas rejected C.R.M. 6057 of 2021 (via video conferencing) In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Sarenga Police Station Case No. 41 of 2019 dated 22.08.2019 under Sections 406/409/418/419/420/467/468/120B of the Indian Penal Code.

And In Re : Mr. Tarun Kumar Patra ..... petitioner Mr. Soumik Ganguli ... for the petitioner Mr. Rudradipta Nandy ... for the State Learned Counsel appearing for the petitioner submits he is the Assistant Manager of the Co-operative Society and has been falsely implicated in the instant case. Recovery proceedings has been initiated against him and he is contesting the said proceeding. He may be granted anticipatory bail. Learned Counsel appearing for the State opposes prayer for anticipatory bail and submits that the petitioner in conspiracy with the Manager of the Co-operative Society and others misappropriated over crores of rupees through false loan withdrawals.

We have considered materials on record. Petitioner along with co-accused persons misappropriated large sum of money from the Co-operative Society. False loan withdrawals were made in favour of Mr. Swapan Kumar Barui and Mr.

Baidyanath Bayen to the tune of over Rupees one crore and the petitioner played an active role therein.

In view of gravity of the offence and prima facie involvement of the petitioner in that misappropriation of public funds, we are of the opinion this is not a fit case to grant anticipatory bail to him.

Accordingly, prayer for anticipatory bail is rejected. (Bivas Pattanayak, J.) (Joymalya Bagchi, J.)
