P., Mr. Raja Saha, Mr. Debasish Ghosh ....for the State The writ petitioner is aggrieved that his excavator has been seized by the Haldia Police in connection with FIR No. 80 of 2021 dated 12.07.2021. The writ petitioner claims that he is no way connected with the subject matter of the FIR.

Counsel for the State submits that investigation is now with the C.B.I by virtue of Court's order dated 12.02.2022 passed in WPA 1722 of 2022 along with CRR 1704 of 2021.

In that view of the matter, the petitioner's remedy is Chapter 13 of the Cr. P. C. before the appropriate court to seek return of his vehicle. With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.
