The petitioner retired from service on December 31, 2018. A disciplinary proceeding was pending against him which was later dropped. There had been delay in disbursement of his terminal dues. 2.

The petitioner claims to have received the PPO and thereafter pension on January 5, 2024. Prayer has been made to direct the authority to pay interest on account of delayed payment of his terminal dues as the delay was in no way attributable to the petitioner.

From the facts which are admitted on record, it appears that the disciplinary proceeding against the petitioner, which continued even after his retirement, stood dropped as charges of his active involvement in the subject incident was not substantiated in the report of the inquiry officer. It does not appear that the petitioner was in any way responsible for the delay in issuance of the PPO and his terminal benefits.

Accordingly, the petitioner would be entitled to interest on account of such delayed payment.

Accordingly, the instant writ petition is disposed of by directing the DI of Schools (SE), Uttar Dinajpur to calculate interest on and from the next date of retirement of the petitioner i.e. January 1, 2019 till the date prior to receiving his terminal dues, i.e. January 4, 2024 at the rate of 5% p.a. The amount on account of arrear shall be credited in favour of the petitioner positively by March 31, 2026.

The Treasury Officer, Islampur and the Director of Pension, Provident Fund & Group Insurance, West Bengal will cooperate in complying with the direction passed by this Court.
