1. The learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated.

2. The learned Counsel for the State in opposing the prayer for anticipatory bail has referred to the statement of the eyewitnesses directly implicating the petitioner. He has also referred to the injury report.

3. Considering the materials available in the case diary and the victim suffered injury to the assailant of Mithun as transpired from the statement of the eye-witnesses recorded under Section 161 of the Criminal Procedure Code and also having regard to the injury sustained by the petitioner, we are not inclined to grant anticipatory bail to the petitioner.

4. Accordingly, the prayer for anticipatory bail is rejected. (Soumen Sen, J.) (Uday Kumar, J.)
