Learned counsel for the petitioner submits that the petitioner and the victim lady with the major and residing together as husband and wife. Learned counsel submits that even the complaint lodged is only regarding the theft. 2.

Learned counsel for the State submits that victim had made specifically allegation of rape. I have perused the CD. The victim lady in her statement has specifically stated that she was in a relationship with the petitioner and had been residing with him for six months as husband and wife. There were allegations of theft against the petitioner.

Taking into account and facts and circumstances and the statement of the victim, the petitioner is directed to join the investigation as and when directed by the Investigating Officer. In case the Investigating Officer feels the necessity of affecting the

arrest of accused. The petitioner shall be released on bail upon furnishing a personal bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Murshidabad. Subject to the further conditions that the petitioner shall not contact the prosecutrix victim in any manner. Nor shall he threaten, tamper or intimidate the prosecution witnesses. 4.

The application for anticipatory bail is, thus, allowed. 5.

All parties shall act on the basis of the server copy of this order.
