The petitioner first had joined at Bagnan Girls High School (H.S), Bagnan, District- Howrah as an Assistant Teacher in the subject Mathematics but on mutual transfer she is now working at Thekuachak Chhatri Siksha Niketan (H.S), Purba Medinipur.

The petitioner is praying that the authorities may be directed to consider her application for general transfer to any school in Kolkata on the ground that she is female teacher and she has a minor daughter.

Learned Counsel for the petitioner submits that the petitioner has been driven out of her matrimonial home at Purba Medinipur as such it would be inconvenient for her to continue her service in a school in the said district, he further

submits that the matrimonial proceedings between the petitioner and her husband are pending before the competent Courts at Alipore District. 24Parganas(South), which is the other ground for praying such transfer.

There is nothing on record to suggest that the matrimonial discord between the petitioner and her husband has accelerated to an extent resulting complete impossibility for the petitioner to attend her regular duty in the school, besides even if such situation occurs, the petitioner should have reported the same before the Courts where proceedings are pending between the petitioner and her husband.

The grounds for transfer, therefore, do not appear convincing enough to this Court to entertain the prayer of the petitioner for general transfer.

W.P.A. 13807 of 2023 is dismissed with the above terms without any order as to costs.
