The petitioners have prayed for transfer of Misc. Case No. 180 of 2018 pending before learned Judicial Magistrate, 4th Court, Durgapur to any court within the jurisdiction of Chandannagar, Hooghly or Howrah.

I have perused the contentions advanced in the application for transfer and I find that the only ground is available at paragraph 9 of the application wherein it has been contended that the present petitioners were threatened by unknown persons that their lives would be in danger. No document to that effect has been produced or enclosed along with the present revisional application. However, the apprehension of the present petitioners cannot be at this stage ruled out.

Accordingly, if the petitioners so feel, they would, prior to entering the jurisdiction of Durgapur, inform the Inspectorin-Charge, Durgapur Police Station who would provide necessary protection in case, the present petitioners face any difficulty or are threatened by any unknown persons or associates which they have alleged.

No interference is made with regard to the transfer of the instant case at this stage.

With the aforesaid observations, the revisional application being CRR 2133 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
