20.01.2022 sayandeep Sl. No. 06 Ct. No. 05 WPA 14508 of 2021 [Via Video Conference] Pramod Kumar Mahato -Versus- University of Calcutta & Ors.
Mr. Shamim-ul- Bari Ms. Molly Saha ..... for the petitioner Mr. Raja Saha Chatterjee Mr. Nilotpal Chatterjee Mr. Satyaki Banerjee ..... for the University Mr. Sabyasachi Bhattacharya ..... for the respondent The petitioner's prayer for a direction on the University to assess the answer script of the petitioner in B.A.
Part-I Supplementary Examination in Philosophy and for publishing the result of the Examination cannot be entertained since the petitioner admittedly enrolled in the B.A. course in 2009 and the relevant Notification of the University of Calcutta Notification No. CSR/27/13 dated 16th September, 2013 provides that candidates shall have to clear Part-I, II and III Examinations within a total span of ten years from the year of Registration subject to fulfillment of other conditions of the existing Regulations. The time frame within which the petitioner hence had to complete all three parts was 2019 since the petitioner was enrolled/registered in 2009. The plea of
the petitioner is that the petitioner was allowed to appear in the Part III Examination in 2020 pursuant to two letters of the Principal of the College to the University does not assist the case of the petitioner since learned counsel appearing for the College submits that the petitioner appeared without a roll number and was not officially given the link for the online examination.
In view of the above reasons, WPA 14508 of 2021 is dismissed without any order as to costs.
